Terms and Conditions
These terms apply when you use devianseo.online, download the free book or other resources, join the community or a membership, or work with me. Please read them; by using the site or the services, you agree to them.
Who I am
This website and its services are provided by Mushambo Jason Derrick, trading as Devian Chard (“I”, “me”, “we”), an AI automation and SEO consultant. Contact: devianchard021@gmail.com, +256 780 771 571.
Using this website
You may use the site for lawful purposes only. Please don’t:
- try to disrupt it, overload it or get into parts of it that aren’t meant to be public;
- use automated tools to copy large parts of it, or reuse its content commercially without permission;
- submit forms with false details, someone else’s details, or content that is unlawful, abusive or spam.
I may refuse or remove any submission, and block access, where these terms are broken.
The free book and other free resources
The book The Agentic OS, the playbook, checklists, calculators, templates and articles are free. You may use them to run your own business and share the link to where you found them. You may not sell them, republish them as your own, or remove the author’s name from them.
They are general information, offered in good faith. They are not advice tailored to your situation, and what works depends on your market, budget and execution. Calculators give estimates based on what you enter, not forecasts or promises.
Consulting and AI automation services
The agreement. Paid work, such as SEO, link building, AI search visibility, AI automation or building agent systems, starts only once we both accept a written proposal or agreement. It sets out the scope, deliverables, timeline and fees. If it conflicts with these terms, the proposal or agreement wins.
Fees and payment. Unless the proposal says otherwise, fees are quoted in US dollars, one-off projects are paid in full or in agreed stages before each stage starts, and monthly services are billed monthly in advance. Overdue invoices may pause the work until they are paid.
Changes to scope. Work outside the agreed scope is quoted separately and starts only once you approve it.
Your responsibilities. You agree to give the access, information and approvals the work needs, on time, and confirm you have the right to share them. Delays on your side may move the timeline.
Your accounts, content and data stay yours. You keep ownership of your websites, accounts, content and data. When a project is paid in full, you own the deliverables made specifically for you. I keep ownership of my own tools, methods, templates and know-how, and you get a licence to use anything of mine that is built into your deliverables, for your own business.
AI-assisted work. Some work uses AI models and agent systems. AI can produce errors or content that needs correcting, so nothing is published, sent or put in front of your customers without the approval step agreed in the proposal. You remain responsible for anything you approve for publication.
Third-party platforms. The work depends on platforms I don’t control, such as Google, AI assistants, hosting providers and the APIs and models the systems use. Their rules, prices and availability can change, and their charges are yours unless the proposal says otherwise.
Confidentiality. I keep your non-public information confidential and use it only to do the work. Case studies about your project are published only with your written permission.
Ending the work. Monthly services can be cancelled by either of us with 30 days’ written notice, unless the proposal says otherwise. Fees for work already done, or for the notice period, remain payable.
Community and memberships
The free community and any paid membership have house rules: be respectful, don’t spam or sell to other members uninvited, and don’t share other members’ information or private material outside the community. I may remove anyone who breaks these rules.
Paid memberships, where offered, are billed in advance for each period and renew until you cancel. You can cancel at any time before the next renewal and keep access until the end of the period you have paid for. Payments already made are not refunded for partial periods, except where the law requires it.
Strategy sessions
The free strategy session is a no-obligation conversation. Please give at least 24 hours’ notice if you need to cancel or move it. Nothing said on the call is a guarantee of results or a binding quote until it is set out in a written proposal.
No guarantee of results
Search engines and AI platforms decide their own rankings and answers, and change them without notice. I don’t guarantee any specific ranking, AI citation, traffic, lead, sale, saving or other result. See the earnings and results disclaimer.
Intellectual property
The content, design, text, graphics and code of this website, and the free book, belong to Mushambo Jason Derrick (trading as Devian Chard) or are used with permission. Other names and trademarks mentioned belong to their owners and are used only to describe products and services.
Limitation of liability
Nothing in these terms limits or excludes liability that the law does not allow to be limited, including for fraud, or for death or personal injury caused by negligence.
Otherwise, to the extent the law allows:
- the website and free resources are provided “as is”, and I am not liable for any loss arising from using them;
- I am not liable for indirect or consequential loss, or for loss of profit, revenue, data or opportunity;
- my total liability to you for paid services is limited to the fees you paid me for those services in the 12 months before the claim arose.
Links to other websites
The site links to other websites and tools. I’m not responsible for their content, availability or how they handle your information.
Privacy
How personal information is handled is explained in the privacy policy.
Changes to these terms
I may update these terms from time to time; the “Last updated” date above shows when. Changes apply from that date, but they don’t change a proposal or agreement already signed.
Governing law and disputes
These terms are governed by the laws of Uganda. If a dispute arises, we will first try to settle it in good faith by talking. If that fails, the courts of Uganda have jurisdiction. If you are a consumer living elsewhere, you keep any protections your local law gives you that cannot be excluded.
